GUIDELINES AND INSTRUCTIONS FOR MEMBERS, THEIR GUESTS AND VISITORS

1. Title. – These Rules shall be called the “The Rules for Members of FX Boxing Club”. 

2. Commencement. – These Rules shall come into force on twenty-fifth day of February 2020. 

3. Application – These Rules shall apply to all the Members of the FX Boxing Club. 

4. Definitions. – In these Rules, the terms used shall have following meaning: 

(a) “Club”, shall mean FX Boxing Club and as the context may require to include the employees, officers, directors, agents, trainers, consultants and  representatives-in-interest of the Club, 

(b) “Member” shall mean person who has subscribed to the facilities offered by the Club in accordance with the Rules. Temporary Members, Guests of the  Members and Visitors shall be considered Members for the purposes of these Rules. 

(c) “Rules” means these Rules of the Club as may be amended, modified and altered by the Club from time to time. 

 

5. Interpretation. – The management of the Club shall have the sole authority for the interpretation of these Rules and of Guidelines and Instructions issued thereunder,  and the decision of the management in respect of any such interpretation shall be conclusive and binding on all the Members.

 

6. FX Boxing Club.  

(a) There shall be a club or a group of clubs individually and collectively named as FX Boxing Club. 

(b) The Club shall be a full-service boxing club which inter-alia shall offer training sessions for professional and amateur boxing, gym facilities for physical  fitness and strength and prescribes food supplements and physical exercises to its Members under supervision of trained coaches.

 

7. Membership of the Club.  

(a) The Membership is a license for the Member to use the facilities and services of Club during the Membership term. 

(b) The Membership is Non-Transferable & Non-Refundable. 

(c) The Membership is for a defined period of day/month/year as may be prescribed. During the Membership period the Member shall be entitled to number  of training sessions, which the Member must complete during the term of Membership. No refunds are given in part or whole for any unused time or sessions remaining before the expiration date. 

(d) The membership requires cancellation and will renew automatically if no notice is given at least 14 days before the expire date. (e) In case the package chosen by the Members is unlimited annual subscription which shall come with a free period attached to the fixed term, the free  period shall commence only upon expiry of, and subject to full payment for the fixed term membership and the member shall waive all rights to make any  claims whatsoever on the free period arising from any reasons or circumstances of the Club or others. 

(f) Membership may be suspended in the event of a Club’s training facility going under repair, redevelopment or relocation. In such circumstances the  remainder of the membership payments will restart at the point of re-opening and continue per the original terms of membership. (g) The Club is a private Members Club and the management reserves the right to refuse Membership to any individual without any cause. (h) Any individual who is capable of entering into an enforceable contract under the laws of Singapore and has age of eighteen (18) years or above may become Member of the Club upon payment of the prescribed subscription charges in such amount and in such manner as may be prescribed by the Club from time to time for different categories of subscribers and accepting to the Rules of the Club. 

(i) The Club minimum membership term is 6 Months. 

 

8. Fee and Payment Thereof.  

(a) To avail the facilities of the Club, the Member shall pay prescribed subscription fee in Singapore Dollars in advance in the bank account designated by the  Club, direct debit, via the Club website using the credit/debit card and furnish a copy of the payment clip or in Cash at the front desk and obtain an official  receipt of payment, or in such other manner as may be prescribed by the Club. 

(b) The subscription fee does not include the Goods and Services Tax or any other tax, duty or levy, which shall be separately payable by the Member. (c) Where the package specifies the payment of fee on monthly basis, such fee for each month shall be payable by the fifth day of each month. In case of  non-payment within stipulated time, the Club reserves the right to suspend the Membership, bar entry to the Club and access to the facilities of the Club. (d) The delay in payment of the fee on time shall hold the Member liable for penalty at the rate of Singapore Dollar SGD $5 per day in addition to the  prescribed fee. 

(e) Continuing default for a period more than fifteen (15) days may result in the cancellation of Membership by the Club. 

(f) The Club reserves the right to revise, amend, modify or alter the rates of the Subscription Charges at any time.

9. Freezing, Suspension, Cancellation and/or Termination of the Membership. 

(a) Medical Cancellation: You may cancel and/or terminate this Agreement for medical reasons prior to the expiry of the Minimum Term Expiry Date. If you  wish to cancel and/or terminate the membership due to medical reasons, your doctor must provide the relevant certification(s) indicating that your use of  the Club facilities and/or services would impair your health.  

(b) Relocation Cancellation: You may cancel and/or terminate this Agreement before the Minimum Term Expiry Date by giving us thirty (30) days written  notice in the event that you permanently move your residence from Singapore. If you wish to cancel and/or terminate the membership due to relocation,  we will require proof of your new permanent residence.  

(c) In the event of death or disability, the liability for membership fees will terminate as at the date of death or disability. If the Club's facilities become  temporarily unavailable due to an event such as a fire, flood, loss of lease, or the like, we will extend your membership privileges for the period the facilities  were unavailable.  

(d) Cancellation prior to the expiry of the Minimum Term Expiry Date: You may cancel and/or terminate your membership due to medical or relocation  reasons prior to the expiry of the Minimum Term Expiry Date subject to a cancellation fee of S$300.00 for 6 months membership early cancellation and/or  S$300.00 for 12 months membership early cancellation.  

(e) Cancellation after the Minimum Term Expiry Date: You can cancel your membership after the Minimum Term by giving the Club thirty (30) days prior  written notice. Cancellation will commence at the end of the 30-day notice.  

(f) The Club retains the sole and absolute right to cancel and/or suspend the membership of any person for any reason. If such cancellation and/or suspension  is made due to a breach of any of the terms of this Agreement, including the Membership Policies and Safety Notices, or due to damage caused by you, the  balance of your financial obligations under this Agreement shall become immediately due and payable, including the cancellation fee S$300.00 for 6 months  membership early cancellation and/or S$300.00 for 12 months membership early cancellation. In the case where the facility or its contents are damaged,  you will also be responsible for the repair or replacement thereof.  

(g) You can request to freeze your membership rights for a minimum of one (1) month and a maximum of three (3) months by giving the Club thirty (30)  days prior written notice. The granting of such request is at the sole and absolute discretion of the Club and you may be required to pay a portion of the  membership dues accruing during this period. The Minimum Term Expiry Date will be extended to take into account the period during which your  membership rights are frozen.  

10. Terms and Conditions for Members. – The Terms and Condition for Membership of each subscriber to the Club shall be governed by the Rules as amended from  time to time. 

11. Representation and Warranties.  

(a) Any person desiring to subscribe to the facilities of the Club shall confirm before subscription that: 

(a.1) he has consulted his doctor and that he is physically fit and has no medical condition which may prevent him from participation in training  sessions offered by the Club, 

(a.2) he is in good health and does not suffer from illness or communicable disease which may render his use of Club facilities injurious or harmful to  others and/or to himself. He shall undergo medical checkup and provide a medical clearance from his doctor, if necessary, prior to starting a new or  revised exercise program or physical activity, 

(a.3) he understands that the use of the Club facilities and equipment and the physical activities at the Club involve serious risk of injuries and even  death. 

(a.4) he further understands that the strength, conditioning, aerobic exercise, Boxing and Muay Thai, including the use of equipment are potentially  hazardous activities. 

(b) The Membership of the Member shall be void ab-initio, if the any of the representation or warranty above is false or inaccurate, irrespective of whether  the misrepresentation is innocent or fraudulent. 

12. Waiver of Liability. - Any person desiring to subscribe to the facilities of the Club shall confirm that: 

(a) He intends to subscribe to the Club’s facilities on his volition and that he shall use the Club facilities and equipment at his own risk and cost, (b) He is aware of and has fully understood that involve risk of serious injuries and even death, 

(c) He shall be participating in the fitness programs, training sessions and exercises and be using of equipment and machinery voluntarily with full knowledge  of the danger involved assuming all health risks including risk of death, 

(d) He shall be solely responsible for the safety and security of his belongings within the Club, 

(e) He understands that novel coronavirus (Covid-19) is highly contagious and he may get infected from the virus despite the Club takes all possible  precautionary measures to prevent the spread of the virus, and that he shall not hold the Club, its employees, shareholders, directors, contractors liable for 

 

any personal injury, financial loss, damage to property, theft of property (including those placed in lockers), infection, death, and/or any other consequential  misfortune or accident which may occur as a result of accessing and using the Club facilities and equipment. 

(f) He shall not hold the Club liable for the unavailability of classes, training sessions or events due to non-availability of the equipment, facility, or service at  any time due to any act of God, mechanical breakdown, fire, catastrophe, or any other reason beyond control of the Club. 

13. Indemnity. – The Members shall indemnify and hold the Club harmless against all responsibility, claims, actions, suits, procedures, costs, expenses, damages and  liabilities for any loss of and/or damage to any property due to and/or arising out of any cause whatever whether directly or indirectly, while entering into, or leaving  the Club’s premises nor for any death or injury sustained from whatsoever cause by any member whilst entering into, upon or leaving the Club’s premises or whilst  participating training sessions, classes, or other sport events. Notwithstanding that such loss and/or damage to property and/or such death or injuries is sustained or  occurred by reason of any negligence and/or default on the part of the Club, or any member, Officer or Servant thereof. 

14. Bookings and Cancellation.  

(a) The Member must reserve the time slot for the classes, training session or other events using the online booking link available at the official website of  the Club which shall be allocated keeping in view the availability of the time slot. No Training session shall be provided by the Club without advance booking.  The Member understands that there may be occasions when their preferred appointment date and/or time is fully booked for some or all of the training  credits or purchases. In the event that no spaces are available for either preferred or alternate appointments the Member shall not hold the Club responsible  or liable in any way. The Member accepts that the Club has acted in good faith by providing a facility to the participant via the Online Booking System to  secure future appointments in order to redeem or recoup his training credits or purchases. 

(b) The Member may cancel the booking by serving a 24-hour advance cancellation notice. Failure of the Member to attend the pre-booked classes, training  sessions or other events without advance cancellation shall render the Member liable for the full fee. 

(c) The Club may post-pone, reschedule and/ or cancel any class, training session or any event whether or not booked by the Member at any time without  prior notice for any reason whatsoever and the Member shall have no claim against the Club in this regard. 

(d) The Member shall not hold the Club liable for the unavailability of classes, training sessions or events due to non-availability of the equipment, facility,  or service at any time due to any act of God, mechanical breakdown, fire, catastrophe, or any other reason beyond control of the Club. (e) No refund is given in part or whole for any unused sessions or time remaining should the Member wishes to cancel his Personal Training sessions or  Classes at any time. 

 

15. Opening Hour.  

(a) The Club shall remain open from 7am to 10pm during five (5) days of the week, excluding weekends. 

(b) The Club reserves the right to alter the opening hour at any time without prior notice to the Member. 

(c) The Member understands that appointments will begin and end promptly as scheduled. The Member acknowledges that any delays to the start of a  scheduled appointment will not be a cause to extend the provided service beyond the remainder of the scheduled time. The Member shall not expect or ask  the Club’s trainer to run overtime. The Member understands that if he is 15 minutes late the appointment will be cancelled and the Member will be charged  for that session and/or not be issued a refund. 

(d) The Member understands that sessions will run approximately one hour unless otherwise stated. The Member acknowledges that a delay to a scheduled  session cannot change the session status to anything else except a whole session and that there shall be no half sessions because of any delay.

 

16. Entry in the Club and access to the facilities.  

(a) The entry in the Club and access to the Club facilities shall only be permitted during the opening hours to the Member after reservation for the classes,  training session or other event, with a valid Membership, in date and in credit. In case the Member has an amount due to be paid on his account, he may  not be allowed to enter the Club and access the facilities of the Club. 

(b) The Club reserves the right to forbid entrance of the Member or access to the facilities of the Club who is intoxicated, ill or whose entrance otherwise  may in the opinion of the Club endanger his own safety or the safety or security of the management of the Club or other Members.

 

17. Guests.  

(a) Guests of the Member are welcome to use the facilities and services of the Club, by purchasing a 1-day gym pass online or by cash payment at the front  desk subject to accepting the Terms and Conditions for Membership and the Guidelines and Instructions issued from time to time as if they are Members of  the Club. There shall be no limit to the number of day passes a guest of the Member may purchase and use. 

(b) The club may deny access of the facilities to the guests during peak sessions. 

(c) The Member introducing a guest shall be responsible for the observance by such guest of these Rules, Guidelines and Instructions of the Club.

 

18. Lockers.  

(a) Subject to availability, the Member may rent lockers for a specified period at the charges prescribed by the Club from time to time.

(b) Lockers shall also available to the Member (“Daily Lockers”). Member shall not be permitted to use Daily Lockers overnight. The Club reserves the right  to reopen Daily Lockers for which the keys have not been returned to the Club before the close of the business day, and any belongings therein will be  disposed of the next day without any liability of the Club. 

(c) The Member shall be responsible for payment of Singapore Dollar SGD $10 for the locker key replacement. 

(d) The Member and his guests are advised to use the lockers in the interest of their own safety and security. The Member shall be solely responsible for the  safety and security of his belongings within the Club and that he shall not hold the Club liable for any loss, damage, theft, or consequential damage to any  of his belongings or personal property including those placed in the lockers or entrusted to any personnel of the Club. 

 

19. Insurance by the Member 

The Member is advised to obtain personal insurance for any loss, injury or damage that he may sustain as during or after the training sessions or a result of use of the  Club. However, obtaining the insurance by the Member shall not be mandatory and shall be obtained at the sole discretion and expense of the Member.

 

20. Use of Facilities of the Club. 

(a) The Member shall use facilities provided by the Club with utmost care and diligence and in accordance with the instructions for use issued by the Club. (b) The Member shall at all times use the Club and facilities provided in such manner so as not to interfere with the reasonable comfort of, or be a nuisance  to, other members of the Club and so as not to damage or possibly damage the Club property. 

(c) The Member shall be liable for any loss or damage caused to the Club, its building, fixtures, or facilities resulting from breach of paragraph one above.

 

21. Prohibitions.  

(a) The Member must not seek classes, training sessions etc. from any outsider or unauthorized personnel of the Club. Only authorized personnel of Club  are permitted to offer any kind of personal training or services within the Club premises to the Members. 

(b) The Member must not offer or provide the classes, training sessions etc. to any other Members or person within or outside the Club. (c) No person (unless expressly authorized to do so) shall take away, or permit, to be taken away, from the Club, under any pretenses whatsoever, or shall  injure or destroy, any property of any kind whatsoever belonging to the Club. If a member offends against this rule he shall, and if a guest offends this rule  the member who introduced him shall, pay the cost of replacement and/or repairs as well as a fine in such amount as the Committee shall in its sole discretion  determine from time to time. 

 

22. Termination of Membership by the Club. 

(a) The Club may at any time without advance notice cancel the Membership without any cause and refund the proportionate amount of fee received in  advance. 

(b) The Membership can also be terminated for cause if the Member is found by the Club to have breached any provision of the Rules, Guidelines or  Instructions issued by the Club. In this case the Member shall not be entitled to the refund of any advance fee paid to the Club.

 

23. Confidentiality.  

(a) The Member understands and acknowledges that, by virtue of being a Member of the Club, he may receive or become aware of information belonging  or relating to the Club, its business, business plans, affairs or activities, training manuals and supplements which information is confidential and proprietary  to the Club and in respect of which the Member shall be bound by a strict duty of confidence. 

(b) The provisions of this rule shall continue without limit of time, notwithstanding the termination of Membership for any reason.

 

24. Force Majeure. 

(a) “Force Majeure” means war, emergency, accident, fire, earthquake, flood, storm, pandemic, industrial strike, change of laws or regulations or any other  impediment which is beyond control of the Club which could not reasonably be expected at the time of becoming any Member and the Club have taken  reasonable measures to avoid or overcome its consequences affecting the performance of any obligation by the Club. 

(b) For a breach resulting from Force Majeure, the Club shall not be deemed to be in breach of the Rules, or otherwise be liable to the Member, by reason  of any delay in performance, or the non-performance, of any of its obligations to the extent that the delay or non-performance is due to any Force Majeure  of which it has notified the other Party. The time for performance of that obligation shall be extended accordingly, subject to rule below. (c) If the performance by the Club of any of its obligations is prevented or delayed by Force Majeure for a continuous period in excess of three months, both  the Club and the Member shall be entitled to terminate the Membership by giving written notice to the other party without any further liability except the  liabilities which have arisen or relate to the period prior to the date of notification of Force Majeure. 

25. Power to Amend, Modify and Vary. 

(a) The Club may in its sole discretion suspend, revise, amend, alter or modify these Rules of the Club, Guidelines and Instructions for Members, offered  options and plans, rates, group Classes etc. at any time and such suspension, revision, amendment, alteration or modification shall be binding on the  Member.

 

(b) The Club may give any amendment, modification or alteration retroactive effect and apply the same to the existing subscribers.

 

26. Applicable Law and Dispute Resolution. 

(a) The Rules of the Club and any Guidelines and Instructions shall be governed by and construed in accordance with the Laws of Singapore. (b) Any dispute or difference, or question arising out, in connection with, or relating to the Rules of the Club or Guidelines and Instructions for Members  including the question of breach, compliance or termination of Membership shall be settled finally by arbitration in accordance with the Singapore law  relating to domestic arbitrations through a sole arbitrator appointed by mutual consent of the Member and the Club. 

(c) The language of the arbitration shall be English. 

(d) It shall be a legal obligation on the part of any Member who has a dispute or difference with the Club to make genuine attempt to resolve such dispute  or difference through mediation before such member resorts to arbitration. 

27. Power to issue Guidelines and Instructions. – The Club shall have the power to issue Guidelines and Instructions and make amendments, modifications therein  from time to time to regulate the classes, training sessions and conduct of its Members. Such Guidelines and Instruction shall be posted on the official website of the  Club and pasted at a conspicuous place within the Club and shall be binding on the Members. 

 

28. Publication of the Rules. – The Club shall publish the Rules as amended from time to time on its official website from general information. 29. Acceptance of the Rules etc.  

(a) By accessing and/or using the Club facilities and/or Classes, or clicking acceptance button to indicate the consent, the Member shall accept and agree to  be bound by these Rules and Guidelines and Instructions, just as if the Member had agreed to them in writing, and the use of electronic signatures initiated  or completed through the site or services offered by the Club. 

(b) The electronic signatures obtained through online portal shall be conclusive proof of the acceptance of the Rules and Guidelines and Instructions for  Members and can be used before any competent authority as evidence of such execution. 

 

1. GENERAL 

1.1 Dress appropriately for the activity you will engage in. Please wear appropriate footwear (no open toed shoes). Clothing should be comfortable, but not too loose. 1.2. Have a water bottle and towel with you. 

1.3. Eat before you start a session. Proper nutrition is the foundation of a healthy body. Working out on an empty stomach may cause dizziness and premature fatigue.

 

2. HEALTH  

2.1 Answer the questions on the Medical History form to the best of your knowledge. Medical clearance is required if you have any medical problems and have answered  yes to any of the questions on the medical release form. 

2.2. If you feel light-headed, dizzy, faint, nauseated or experience pain or discomfort stop the activity and inform your personal trainer. 2.3 The results of any fitness program cannot be guaranteed. Your progress depends on your effort and cooperation in and outside of the sessions. 2.4 It is your responsibility to inform your personal trainer of any conditions or changes in your health which might affect your ability to exercise safely with minimal  risk of injury. 

 

3. CLASSES 

3.1 Group exercise classes need to be pre-booked (either at reception or online) as they have maximum head counts. Timetables and instructors may change without  notice. Where possible, we will post the details on CLUB display boards. 

3.2 To make it fair for everyone, members can have six class bookings at any given time. Three of the six bookings will be able to be used for “hot” classes indicated on  the timetable by a flame. If members cancel a class within 1 hour of the class starting, this will count as a strike. Members will be locked out of the booking system for  28 days if they receive 3 strikes within 28 days. Members will still be able to attend a class if there is a spot available. 

3.3 If you’re more than 10 minutes late for a group exercise class you will not be able to join in. We want to start classes on time as your time is precious. Please arrive  a few minutes early. Make sure you warm up before you get physical. 

3.4 Our instructors will limit the number of attendees to set class numbers. 

3.5 Many sessions are booked back to back. It is very important to be on time for your session. If you arrive late for a session, it will still end at the scheduled time. If  the trainer arrives late, you will receive a full hour. 

3.6. It is important for us to respect our instructors' work schedules. Therefore, we ask that you provide a minimum of 24-hour notice if you are unable to attend an  appointment. Less than 24-hour notice will result in charge for the missed session. 

 

4. IF YOU BRING A FRIEND 

4.1 At our discretion, members may bring guests to our CLUBs by paying the guest fee set out in our CLUB Price List. 

4.2 Guests must play by these CLUB Rules. 

4.3 You must accompany your guest(s) at all times, be responsible for their behavior and make sure that they play by these Rules. Please don’t leave our CLUB prior to  your guest’s departure 

5. GENERAL CLUB USE 

5.1 We’ll post opening and closing times on CLUB display boards and our website. 

5.2 Don’t bring alcohol or illegal drugs into our CLUBs. 

5.3 If you bring in food or drink from outside the CLUB, please don’t consume it inside our CLUBs. 

5.4 You may bring guide dogs into our CLUBs. Careers may enter our CLUBs with the member they are caring for but cannot work out in the CLUB when caring for a  member. 

5.5 Don’t use the CLUB facilities while under the influence of alcohol, anticoagulants, antihistamines, beta blockers (unless you provide medical clearance), narcotics,  or tranquillizers. 

5.6 Don’t smoke inside or near the entrance to our CLUBs. 

5.7 Please leave the CLUB punctually at our published closing times. 

5.8 Unless we give the OK, please don’t take any pictures, photographs, films or videos via any form of recording device, including phones or cameras, of our CLUB  premises. 

5.9 You’ll need to pay for any loss or damage caused by you or your guests while in the CLUB. 

5.10 We may provide trial access to our CLUBs for potential members and others. 

6. EQUIPMENT, THE TRAINING FLOOR AND STUDIOS 

6.1 Use equipment for its intended purpose. Follow the instructions provided. Ask for help if you need it. Please do not bring your own equipment into our CLUBs. Be  sure to let us know if any of our equipment is broken or unsafe. 

6.2 No food or bags on the training floor or studios. 

6.3 Only drinks in plastic or aluminum bottles containing water or sports drinks are OK to bring onto the training floor and studios. 6.4 Please think of other people by replacing weights and equipment after use. 

6.5 A towel must be used on all equipment, in all studios and on the training floor. Please wipe down equipment after use. 

7. PERSONAL TRAINING SAFETY 

7.1 Don’t mess around with fire doors or fire exits. 

7.2 Please follow any health and safety notices displayed in our CLUBs. Please let a FX team member know if you are hurt or injured before you leave the CLUB. 7.3 In an emergency or when an announcement is made, be attentive and follow the CLUB staff’s instructions at all times. If you don’t evacuate when asked we will  treat this as a serious breach of these Rules.

 

 

8. LAST BUT NOT LEAST 

8.1 FX Boxing CLUB may occasionally take photographs/images of the CLUB and its facilities (including members). We’ll try our best to get your OK beforehand (so you  can glam up) but this may not always be possible. We reserve the right to use these photographs/images for commercial purposes without payment. We use CCTV to  monitor any incidents at our CLUBs. 

8.2 CLUB Price Lists will change from time to time. 

8.3 We reserve absolute discretion when approving membership applications. 

8.4 Always respect other CLUB members, guests and our staff. Please use the CLUB in a way that doesn’t disturb, detract or impair anyone’s experience. 8.5 Only FX Boxing CLUB fitness professionals can provide personal training in our CLUB. Please do not bring your own trainer into our CLUB.
